Terms of Use

These Terms of Use govern your access to and use of the NamHub app, website, and related services operated by NamHub (Pty) Ltd ("NamHub", "we", "us").

1. Who you are contracting with

You are entering into these Terms with NamHub (Pty) Ltd, a company registered in the Republic of Namibia with its head office in Windhoek. References to "NamHub" mean this legal entity.

2. Acceptance of these Terms

By creating an account or continuing to use NamHub, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Notice and Refund Policy. If you do not agree, you must stop using NamHub.

If you are using NamHub on behalf of a business or other organisation, you confirm that you have authority to bind that organisation to these Terms. If you are using NamHub as an individual, you confirm you are at least 18 years old.

3. Your account

You must provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for all activity under your account. Notify us at safety@namhub.app if you suspect unauthorised access.

4. Acceptable use

You must not use NamHub to: break the law; commit fraud, discrimination, harassment, or abuse; infringe another person's intellectual property; upload malware or attempt to interfere with our security; scrape, crawl or extract data at scale; or circumvent verification, payment, or messaging limits.

You must be honest in your listings, honour the prices and availability you publish, respond to messages promptly, and treat other users with respect.

5. Intellectual property

NamHub, including our software, design system, brand, logos, and documentation, is owned by NamHub (Pty) Ltd and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use NamHub for its intended purpose within your subscribed plan. You must not reverse engineer, copy, resell, or redistribute any part of NamHub.

You keep ownership of the content you upload (listings, photos, messages). You grant NamHub a worldwide, royalty-free licence to host, process, display, and distribute that content solely to operate and improve the service.

6. Payments, subscriptions and Merchant of Record

Our order process for card payments is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics for Paddle-processed orders are governed by Paddle's Checkout Buyer Terms at paddle.com/legal/checkout-buyer-terms.

Subscriptions renew automatically at the end of each billing cycle until cancelled. You can cancel at any time from your account settings. Cancellations take effect at the end of the current billing period; your subscription remains active until then.

Refunds are handled under our Refund Policy at /info/refunds.

7. Service availability and disclaimer

We work hard to keep NamHub available, but we do not guarantee uninterrupted or error-free service. NamHub is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Verified badges reflect documents reviewed by our team at a point in time; they do not replace your own due diligence when transacting with other users.

8. Liability

To the fullest extent permitted by law, NamHub's total aggregate liability arising out of or relating to these Terms or your use of NamHub is limited to the fees you paid to NamHub in the twelve months before the event giving rise to the claim.

NamHub is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under Namibian law, such as liability for fraud, death, or personal injury caused by our negligence.

9. Indemnity

You will indemnify and hold NamHub harmless from claims, losses and expenses arising out of your content, your use of NamHub in breach of these Terms, or your violation of any law or third-party right.

10. Suspension and termination

We may suspend or terminate your account or access to NamHub if you materially breach these Terms, fail to pay fees when due, present a security or fraud risk, or repeatedly violate our policies. Where reasonable, we will give you notice and an opportunity to fix the issue.

You can close your account at any time from account settings. On termination, your licence to use NamHub ends. We may retain data as required by law or to handle disputes.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in the app or by email at least 14 days before they take effect. Continued use of NamHub after the effective date means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Namibia. The courts of Windhoek, Namibia have exclusive jurisdiction over any dispute arising out of or relating to these Terms, subject to any non-waivable rights you have as a consumer.

13. General

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision is unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
